The FTC has filed a Civil Action against Daniel Chapter One and is seeking "penalties" which will prevent Daniel Chapter One from bringing their case to the Court of Appeals.  In the almost 3 years since the FTC attacked the ministry, Daniel Chapter One has not yet received the due process guaranteed by the Constitution. Twenty years of savings has been eaten up by legal fees, and after 2 1/2 years the ministry was deemed guilty as charged in the beginning by the FTC. . .in an FTC court, by an FTC judge, before FTC Commissioners = in a Star Chamber.
 
Judge Emmett Sullivan questioned jurisdiction in the matter, since Daniel Chapter One is in the process of appealing their case before a higher court, and called for a hearing which has been scheduled for Sept. 14th in Washington D.C.
 
The hearing will settle the jurisdiction question, and will also address the alleged violations. The FTC complain that Jim Feijo and Daniel Chapter One has not signed and sent out the letter crafted by them, the FTC, and that people are allowed to call in to the radio program, Daniel Chapter One Censored, and share testimonies and assist other callers who have health questions. They also complain about the Daniel Chapter One Fellowship Forum, and seek to destroy the Fellowship.
 
The federal agency boasts that Congress "intended to coordinate finality with a new weapon which would put teeth into the enforcement machinery", and liken themselves to the SEC as a "statutory guardian charged with safeguarding the public interest."

Both the FTC and the SEC turned a blind eye to the Ponzi-scheming Madoff, and the FTC and the FDA continue to look away from the drugs that kill close to 200 thousand Americans a year. Their behavior belies the masquerade of being public protectors.
 
The FTC complain that DCO share anecdotal evidence versus "scientific proof", yet their entire case against the ministry is merely theoretical. The FTC failed to come up with any evidence of any person ever being harmed or misled by the information DCO shares, and blocked all fact witnesses who wished to testify as "irrelevant".
 
You, Dear Reader, are considered irrelevant by this federal Commission, as well as too stupid to judge a product's worth for yourself.  

To the FTC, God does not exist and the Bible and the Constitution are irrelevant. To the FTC and the present U.S. Government in general, your individual liberty is not considered an unalienable right bestowed by a Creator. That you have a Creator and Father in heaven is not even in the equation.

Please pray for guidance for DCO attorneys Herb Titus and Bill Olson, Judge Emmett Sullivan for a righteous ruling, and for the souls of all who will hear God's Word Tuesday, September 14th.

This site was created to share with you the ongoing battle between Daniel Chapter One and the Federal Trade Commission, a battle of historic importance between a small ministry and a treacherous bureaucratic agency.

Daniel Chapter One stands upon truth and righteousness, upon the Word of God and the Constitution.

The FTC stands for much of what is wrong in big government and the pharmaceutical industry today: the individual they consider "irrelevant" and stupid; "unable". The FTC does not acknowledge an Almighty Creator, nor individual liberty given by Him and protected by the Constitution. They mocked us in court -- and blocked all the Daniel Chapter One witnesses who traveled to testify.

The FTC first came against Daniel Chapter One nearly 3 years ago for sharing (truthful) testimonies and information about God's healing creation. In their Star Chamber they found Daniel Chapter One guilty of one thing only: not having drug-standard double-blind placebo-controlled studies. . . and they ordered the ministry to cease-and-desist, despite not a single complaint in 25 years.

They have ordered that we sign a letter they wrote, a deceptive letter saying that only conventional cancer treatment has been proven safe and effective in humans, and send it to thousands of people.

But Daniel Chapter One cannot bear false witness.

So it is that Daniel Chapter One fights on for the right to teach and preach the ways of our Lord and natural healing.

August 18 we file the appeal brief for the Court of Appeals. Daniel Chapter One soon brings the FTC to court. See all the ways you can get involved, and please do what you can!

Only Group Raising Constitutional Issues About Right to Make Truthful Statements

Standing Up to the FTC:  In mid 2008 an FTC internet witch hunt netted 130 companies and one non profit religious group, Daniel Chapter One that used the words “cancer” and “dietary supplement,” whether truthfully or not, on the same web site.  The FTC charged and ordered all of hem to ceases their “fraudulent”—even though truthful--use of the words and to write to all their constituents that only drugs and radiation are proven to be used for cancer.  No information about cancer and hers—even if true--or testimonies of people whose cancer disappeared after using herbs could be displayed.  Daniel Chapter One: through its lawyers say this violates the Untied States Constitution’s First Amendment rights of freedom of speech, freedom of the press, and freedom of religion.

In Sept 2008, the FTC officially charged the tiny religious ministry with making statements that Daniel Chapter One never actually made!  In a deceptive move, the FTC listed in their Charge statements of supposed health claims they purported Daniel Chapter One to have implied from its structure/function information, with no evidence (and no consumer complaint in 23 years) that any DC1 information is false or misleading.

Daniel Chapter One Overseer Mr. James Feijo and Daniel Chapter One believe strongly that neither he nor his ministry has done anything that they are not entitled to do. He tried, and believes he succeeded, to comply with any and all just and constitutional laws that govern his conduct.

Right to Make Truthful Statements:  The FTC threatened to place a pecuniary and odious Order on DC1, which Mr. Feijo could not agree to. The Order included demands for the  Daniel Chapter One customer list with customers’ personal information, demands that Feijo “waive” his rights and that he  agree to  FTC spying, “posing as customers and clients , (or) employees. . . without the necessity of identification or prior notice.” The Order, not to terminate for 20 years, included many other specific demands which violate Mr. Feijo’s basic philosophy.    Including…

The most egregious part of the Order for Feijo, was a letter written by the FTC , which the Commission proposed an ordered to be printed on DC1 letter head, be signed by Mr. Feijo and mailed to all Daniel Chapter One followers. The letter said that there is no scientific substantiation that any Daniel Chapter One products or ingredients may help in illness.  It ordered Daniel Chapter One to say “(only) conventional cancer treatments have been scientifically proven to be safe and effective in humans.” The FTC letter took it one back-breaking step further.  Daniel Chapter One must, in all its future advertising direct people to- the National Cancer Institute. Again this violated of Mr. Feijo beliefs.

Consumer Rights to Receive Health Information: The Feijos, Jim and his wife Tricia secretary of DC1, resolved to fight for the consumer right to know the truth about cancer and herbs. They hired a good attorney, and came to support a legal team of five as the case grew. They have been speaking out on radio, and presenting their Health Freedom Fight to groups of concerned citizens across the country. A few politicians have voiced support of Daniel Chapter One’s fight.

Daniel Chapter One awaits the verdict from the first hearing held in the FTC building, Washington, D.C., April 21 – 27. The FTC managed to block the testimony of nearly all non expert witnesses who came to defend Daniel Chapter One. Expert Witnesses for Daniel Chapter One testified that there is ample scientific substantiation for all statements actually made.

Daniel Chapter One can show it has helped many people over the past 23 years, with hundreds of radio sound bites and testimonials from people who say their health and life have been improved –even saved – with Daniel Chapter One products and information. Daniel Chapter One was not only part of an unreasonable federal witch hunt, but has become part of a national debate over the right of the individual to information and choice when it comes to health care.

The battle ensued when the FTC demanded Daniel Chapter One immediately desist from providing the public with information on natural alternatives for sickness, especially cancer. If successful, the Federal Trade Commission attack on Daniel Chapter One will limit consumers’ rights to health care choices and freedoms.

Portsmouth, RI, April 17, 2009: Daniel Chapter One, a national Christian radio program and natural healing ministry is heading to court against the Federal Trade Commission (FTC) in a fight to uphold its rights under the United States Constitution. The consumer rights to information, choice, safety and redress (the right to be heard)
are all under attack by the Federal Trade Commission complaint against DC1. Presented
to Congress as the Consumer Bill of Rights by President Kennedy in March of 1962, these
rights form the backbone of wellbeing for individual consumers and for success of the
American market economy. To the extent that the FTC approach to DC1 succeeds, individual
consumers seeking to improve their health and the health of American society as a whole
will suffer important losses.
